Paragould, AR – Jonesboro Right Now – In the wake of harassment citations being issued in the Greene County Tech locker room investigation, local law enforcement is clarifying the legal limits of the charges, while the school district declined to comment on player discipline.

According to an update Friday by Greene County Sheriff Brad Snyder, a state police investigation revealed three incidents where police say a juvenile forced physical contact with victims’ faces using his exposed genitals. The victims reported being wrestled and held to the floor by the offender, with “other players” assisting.

Snyder said the juvenile was cited with three Class A misdemeanor counts of harassment. This resulted in several commenters on JRN’s coverage of the investigation asking the same thing: Why were the charges harassment instead of sexual assault?

The discrepancy comes down to a strict legal threshold in the Arkansas criminal code.

To pursue a sexual offense charge, state law requires prosecutors to prove beyond a reasonable doubt that the physical contact was committed specifically for the purpose of “sexual gratification” (AR Code § 5-14-101). Conversely, a harassment charge only requires proving the intent to “harass, annoy, or alarm.”

“When determining charges for any offense, we must ensure that the elements of the statute match the alleged actions,” Snyder told JRN Monday. “In cases of sexual offenses, the preliminary threshold that must be met and can be proven beyond a reasonable doubt is that the act must involve ‘an act of sexual gratification’ or ‘for purposes of sexual gratification’.”

Snyder noted that his department is bound by the criminal code.

“Laws are passed in the legislature, and we enforce the laws as written,” Snyder added. “Any changes in the current wording of statutes must be amended during a legislative session as part of the legislative process.”

While the legal process now stands in the juvenile court system, questions also remain regarding the immediate consequences for the “other players” who allegedly assisted in holding the victims down.

On Friday, the Greene County Tech School District said it would resume its internal investigation to determine “the extent of each student’s involvement and the appropriate disciplinary action.” The district condemned the behavior as “unacceptable” and promised to reinforce expectations regarding personal boundaries.

However, when asked Monday morning if the involved players had been suspended from the team or if they were allowed to suit up for this past Friday night’s game, the district declined to specify the roster status.

“As you know, I will not be able to comment on student discipline or personnel matters,” Superintendent Scott Gerrish told JRN.

Because juvenile records and student disciplinary files are heavily protected by state and federal privacy laws, it remains unclear what internal consequences the students are facing as the football season continues.
